1. Introduction and Agreement
Welcome to Pretty Freaking Photo.
These Terms of Service (“Terms”) form a legally binding agreement between you and Pretty Freaking Photo Inc., a Delaware corporation (“Pretty Freaking Photo,” “PFP,” “we,” “us,” or “our”).
These Terms govern your access to and use of the Pretty Freaking Photo website, application, artificial-intelligence-powered photo tools, account features, subscriptions, Pretty Edits, galleries, editing tools, downloads, and related products, content, features, and services collectively referred to as the “Service.”
By creating an account, selecting a button indicating acceptance, purchasing a subscription or other paid offering, or otherwise accessing or using the Service, you acknowledge that you have read and understood these Terms and agree to be bound by them.
If you do not agree to these Terms, you must not access or use the Service.
If you use the Service on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity. In that circumstance, “you” and “your” refer to both you and the entity you represent.
Your use of the Service is also subject to our Privacy Policy and Acceptable Use Policy. Additional terms or disclosures presented for a particular feature, subscription, promotion, or purchase also form part of your agreement with PFP. If specific terms conflict with these general Terms, the more specific terms control for the applicable offering to the extent permitted by law.

2. Eligibility and Customer Accounts
2.1 Age Requirement
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or independently use the Service.
If the law where you live requires a higher age to enter into this agreement, you must satisfy that requirement. The Service is not intended for independent use or account creation by anyone under 18.
2.2 Account Information
Certain features require a PFP account. You agree to provide accurate, complete, and current account information.
You may not:
- Create an account using false or misleading information.
- Impersonate another person or organization.
- Use information you are not authorized to use.
- Create an account for another person without authorization.
- Create multiple accounts to obtain additional free usage, Pretty Edits, promotions, or other benefits.
- Create or use an account to evade payment obligations, restrictions, suspensions, or enforcement actions.
Unless PFP expressly permits otherwise, each account is intended for one person and may not be shared among multiple users.
2.3 Account Security
You are responsible for protecting your account credentials and using a strong, unique password.
You may not sell, rent, transfer, sublicense, or share your account or login credentials. You may not access another person’s account without authorization.
If you believe your account has been compromised or used without authorization, notify us promptly at support@prettyfreakingphoto.com.
PFP may require a password reset, revoke active sessions, request verification, or temporarily restrict access when reasonably necessary to protect an account or the Service.
2.4 Verification and Recovery
PFP may request reasonable information to verify account ownership, prevent fraud, protect account security, process account recovery, or authorize a material account change.
If we cannot reasonably verify your authority over an account, we may decline to disclose information, change credentials, transfer control, or complete the requested recovery.
You are responsible for maintaining access to the email address connected to your account and keeping your information current.
2.5 Service Communications
PFP may send communications reasonably necessary to operate the Service or administer your account, including:
- Email-verification messages.
- Password-reset messages.
- Security alerts.
- Billing and subscription notices.
- Transaction confirmations.
- Service updates.
- Policy notices.
- Legally required communications.
Marketing communications will be handled separately where consent or an opt-out option is required by law.
3. The Pretty Freaking Photo Service
PFP provides creative tools that help customers capture, upload, create, enhance, restore, transform, edit, organize, save, and download permitted visual content.
Depending on your account, plan, device, and available features, the Service may allow you to:
- Capture photographs or videos using a supported device.
- Upload a main photograph and permitted reference images.
- Submit creative prompts and instructions.
- Generate, enhance, restore, transform, or edit images using artificial intelligence.
- Apply available looks, effects, adjustments, or editing tools.
- Review and compare results.
- Save eligible images to your PFP Gallery.
- Mark eligible Gallery content as a Favorite.
- Download completed content.
- Use subscriptions and Pretty Edits.
- Access additional tools that PFP may introduce.
Features may differ based on your plan, Pretty Edit balance, device, browser, operating system, location, product version, technical compatibility, system capacity, or other reasonable operational requirements.
PFP may establish limits involving file types, file sizes, image dimensions, reference images, processing frequency, Gallery storage, downloads, Pretty Edits, security, and abuse prevention. Material limits will be disclosed through the Service or before purchase where appropriate.
3.1 Your Instructions
You control the photographs, references, prompts, preferences, and creative instructions you submit.
PFP may use automated systems, artificial intelligence, system instructions, quality-control processes, correction methods, and other technologies to process your request.
You are responsible for reviewing every result before downloading, publishing, distributing, advertising with, selling, or otherwise using it.
PFP’s ability to process content does not mean that the content or its intended use is lawful, authorized, accurate, appropriate, or suitable for a particular purpose.
3.2 Service Changes
PFP is an evolving technology service. We may add, improve, test, modify, replace, suspend, or discontinue features, interfaces, workflows, templates, models, providers, limits, or technical implementations.
A subscription provides access to the features and benefits included with the applicable plan. It does not create a permanent right to a particular AI model, provider, template, interface, workflow, or technical system.
Where a change materially and adversely affects a paid offering, PFP will provide any notice or remedy required by applicable law or expressly promised in these Terms.
3.3 Technical Requirements
Using PFP may require a compatible device, supported software, internet access, and permission to access device features such as the camera, photo library, storage, or downloads.
You are responsible for your device, internet connection, data charges, operating-system settings, browser settings, and required permissions.
PFP does not guarantee that every feature will operate on every device, browser, network, operating system, or third-party platform.
4. Your Content and Permissions
“User Content” includes photographs, reference images, videos, artwork, logos, graphics, prompts, instructions, text, and other materials you submit to the Service.
As between you and PFP, you retain ownership of your User Content. PFP does not claim ownership merely because you submit it.
You may submit User Content only when you possess all rights, permissions, licenses, and consents necessary to:
- Submit it to PFP.
- Permit PFP and authorized providers to process it.
- Request the applicable generation, transformation, enhancement, or edit.
- Use the resulting content as you intend.
You represent that your User Content, instructions, and intended use will comply with applicable law, these Terms, the Acceptable Use Policy, and the rights of others.
4.1 Images of Other People
If your User Content contains another person’s face, body, likeness, personal information, private activity, or other protected interest, you are responsible for obtaining every permission and consent required for your submission and intended use.
You may not use PFP to:
- Exploit another person’s image or likeness without authorization.
- Invade another person’s privacy.
- Create harmful, unlawful, deceptive, harassing, or defamatory impersonations.
- Create or distribute non-consensual intimate imagery.
- Falsely represent another person’s conduct, identity, participation, or endorsement.
- Violate another person’s privacy, publicity, likeness, contractual, or intellectual-property rights.
The technical ability to process an image does not mean you have permission to use it.
4.2 Protected Materials
You are responsible for ensuring that your use of photographs, artwork, logos, trademarks, copyrighted works, locations, products, trade dress, uniforms, or other protected materials is lawful and authorized.
PFP’s processing of content does not provide a license, legal clearance, approval, or confirmation that your intended use is lawful.
4.3 Limited License to Operate PFP
You grant PFP a limited, worldwide, non-exclusive, royalty-free license to host, reproduce, process, transmit, format, modify, and create technical or AI-assisted transformations of your User Content only as reasonably necessary to:
- Perform the actions you request.
- Generate, enhance, edit, save, display, and deliver your results.
- Maintain your account and Gallery.
- Operate, secure, troubleshoot, and support the Service.
- Detect or prevent fraud, abuse, security threats, or violations.
- Comply with applicable law and valid legal process.
This license permits PFP to provide User Content to authorized service providers only to the extent reasonably necessary to provide, maintain, or protect the Service.
PFP will not sell your User Content as standalone content or use your photographs in PFP advertising without your permission.
4.4 AI Training
Submitting User Content does not, by itself, give PFP permission to use that content to train PFP’s own general-purpose artificial-intelligence models.
PFP will not use User Content to train its own general-purpose AI models unless it first provides clear notice and obtains any consent required by applicable law.
Authorized providers may process User Content on PFP’s behalf according to PFP’s applicable agreements with them, their governing terms, and applicable law. Further information appears in our Privacy Policy.
5. AI-Generated Outputs
“Output” means visual content generated or modified by the Service in response to your User Content and instructions.
Artificial intelligence is probabilistic. Results may vary even when identical or similar images, references, prompts, or settings are used.
Outputs may be unexpected, inaccurate, incomplete, inconsistent, offensive, or undesirable. They may contain distortions, artifacts, omissions, additions, substitutions, or unintended changes.
PFP does not guarantee that an Output will:
- Follow every instruction exactly.
- Preserve every facial feature, object, color, or detail.
- Match a reference image perfectly.
- Meet every personal, creative, or professional expectation.
- Be accurate, complete, realistic, unique, or error-free.
- Be suitable for every platform, audience, advertisement, or purpose.
- Qualify for copyright, trademark, or other legal protection.
- Be capable of being reproduced later.
You are responsible for reviewing each Output before using or relying upon it.
5.1 Ownership and Permitted Use
As between you and PFP, and to the extent permitted by applicable law, you own your Output.
To the extent PFP obtains transferable rights in an Output created specifically for you, PFP assigns those rights to you.
This does not transfer ownership of:
- PFP’s software, systems, models, prompts, workflows, interfaces, or technology.
- PFP’s trademarks, names, logos, or branding.
- Templates, stock materials, design elements, or content owned or licensed by PFP or a third party.
- Another user’s content or Output.
- Material in which another person holds rights.
Subject to these Terms, you may use eligible Outputs for lawful personal or commercial purposes.
PFP’s permission does not guarantee that you own every element appearing in an Output, possess another person’s consent, have obtained legal clearance, or can register or exclusively protect the Output.
5.2 Similar Outputs
AI-generated content may not be unique. PFP or its providers may generate identical or similar concepts, subjects, poses, clothing, backgrounds, arrangements, colors, styles, or other elements for different customers.
PFP does not provide exclusivity unless expressly agreed in writing.
5.3 Final Responsibility
You are responsible for determining whether your intended use requires:
- Permission, consent, or a release.
- Copyright or trademark clearance.
- Privacy or publicity-rights review.
- Advertising disclosures.
- AI labels or notices.
- Professional review.
- Compliance with another platform’s policies.
Output must not be presented as authentic evidence of a person, event, place, action, endorsement, or fact when doing so would be unlawful, fraudulent, defamatory, or materially deceptive.
6. Gallery Storage and Deletion
PFP may automatically save eligible generated images to your Gallery.
The Gallery provides convenient access to generated images. It is not intended to be your only permanent storage or backup.
6.1 Standard Gallery Retention
Unless an image is marked as a Favorite or another period is clearly displayed, an image in the regular Gallery will remain available for 30 days from the date it is saved.
After that period, it may be removed from the regular Gallery and moved to Recently Deleted.
You are responsible for downloading or favoriting images you wish to preserve.
PFP may display expiration dates, countdowns, or reminders. Failure to receive an additional email or notification does not extend a clearly displayed retention period.
6.2 Favorites
An eligible image marked as a Favorite is protected from the regular 30-day deletion schedule while:
- Your account remains open and in good standing.
- The image remains marked as a Favorite.
- You do not delete it.
- PFP continues to provide the applicable Gallery functionality.
- Retention is not prohibited by law, legal process, security needs, or enforcement requirements.
Canceling a paid subscription does not, by itself, delete properly saved Favorites.
If you remove Favorite status after the original retention period has passed, the image may move to Recently Deleted.
6.3 Recently Deleted
An image removed from the regular Gallery may remain recoverable in Recently Deleted for an additional 30 days.
During that period, you may be able to restore, favorite, download, or permanently delete it.
Unless restored, the image may be permanently removed from active storage after the recovery period.
Content removed for legal, safety, security, fraud-prevention, or rights-enforcement reasons may be deleted immediately without entering Recently Deleted.
6.4 Permanent and Account Deletion
When you permanently delete an image, PFP will begin removing the corresponding image and active Gallery record. Permanent deletion generally cannot be reversed after completion.
Limited copies may temporarily remain in protected backups, caches, logs, security records, or disaster-recovery systems and will be deleted, isolated, or overwritten under applicable retention practices, except where continued retention is legally required or reasonably necessary for fraud prevention, security, dispute resolution, or valid legal process.
Deleting your account is different from canceling a subscription. Account deletion may permanently remove Gallery content, Favorites, Recently Deleted items, account information, and unused Pretty Edits.
Customers should independently download and preserve every image they wish to keep.
7. Pretty Edits
A “Pretty Edit” is a usage entitlement that permits an eligible customer to submit a qualifying AI-powered creation, enhancement, restoration, transformation, or editing request.
Pretty Edits are not money, securities, cryptocurrency, gift cards, or transferable stored value. Except where required by law, Pretty Edits:
- Have no cash value.
- Cannot be redeemed for cash.
- Cannot be sold, transferred, traded, pooled, or exchanged.
- May be used only through the account to which they were issued or purchased.
7.1 Plan Allowances
PFP currently offers the following monthly allowances:
- Pretty Free: 1 Pretty Edit per month.
- Pretty Starter: 15 Pretty Edits per month.
- Pretty Pro: 40 Pretty Edits per month.
- Pretty Elite: 85 Pretty Edits per month.
Current prices, annual billing amounts, features, and purchase terms are displayed through the Service before purchase.
Pretty Edits included with a plan:
- Reset at the beginning of each applicable monthly usage period.
- Do not roll over.
- Expire at the end of the applicable usage period.
- Cannot be transferred or redeemed for cash.
7.2 When an Edit Is Consumed
Unless a different amount is displayed before submission, one Pretty Edit is consumed only when one qualifying request successfully returns one valid generated image and makes it available through your account.
The standard sequence is:
- Request submitted: no Pretty Edit consumed.
- Processing begins: no Pretty Edit consumed.
- Internal quality review or correction occurs: no additional Pretty Edit consumed.
- Request fails without delivering a valid image: no Pretty Edit consumed.
- One valid generated image is delivered: one Pretty Edit consumed.
Duplicate system events, repeated webhooks, page refreshes, or internal retries for the same request must not create multiple deductions.
After a valid result is delivered, a new generation, revision, regeneration, variation, enhancement, or transformation is a separate request and consumes another Pretty Edit if it successfully returns a valid image.
Uploading, viewing, saving, favoriting, downloading, using an eligible non-AI editing tool, and reviewing existing Gallery content do not ordinarily consume Pretty Edits.
7.3 Purchased Pretty Edit Packs
Customers with an active paid subscription may purchase additional Pretty Edit Packs when available.
Purchased Pretty Edits:
- Are separate from subscription-included Pretty Edits.
- Roll over between billing periods.
- Do not expire while the account remains open and in good standing.
- Remain associated with the account after subscription cancellation.
- Cannot be transferred, resold, exchanged, or redeemed for cash.
PFP ordinarily consumes expiring or subscription-included Pretty Edits before non-expiring purchased Pretty Edits.
7.4 Failed Requests and Balance Corrections
If a request fails before delivering a valid image, it should not consume a Pretty Edit.
If a technical or accounting error causes an incorrect deduction, contact support@prettyfreakingphoto.com. After reviewing relevant records, PFP may restore an Edit, retry the request, correct the balance, provide an account credit, or offer another appropriate remedy.
A valid generated image that does not match a customer’s subjective preference is not automatically treated as a failed generation.
PFP may reconcile a displayed balance with reliable generation, subscription, purchase, and usage records when a temporary display error or duplicate event occurs.
7.5 Misuse
You may not manipulate, exploit, automate, duplicate, transfer, resell, or otherwise misuse Pretty Edits or the systems used to issue, purchase, deduct, restore, or track them.
PFP may correct benefits or balances obtained through fraud, abuse, technical exploitation, account duplication, payment reversal, or mistake.
8. Plans, Subscriptions, and Renewals
PFP may offer free and paid plans, including Pretty Free, Pretty Starter, Pretty Pro, and Pretty Elite.
Before purchase, PFP will display the material terms of the selected offering, including:
- The selected plan.
- The amount charged.
- The billing period.
- Included Pretty Edits.
- Automatic-renewal terms.
- The initial and renewal charges.
- How to cancel.
- Material promotional conditions.
By affirmatively confirming a purchase, you authorize PFP and its payment processor to charge the selected payment method for the displayed price, applicable taxes, recurring renewals, and other purchases you separately authorize.
8.1 Automatic Renewal
Unless identified as non-renewing, a paid subscription renews automatically until canceled.
Monthly subscriptions renew monthly. Annual subscriptions renew annually.
You authorize the applicable renewal charge unless you cancel before the renewal is processed.
An annual plan may display a monthly-equivalent price for comparison. A monthly-equivalent display does not mean you will be charged monthly. The complete annual charge will be displayed before purchase and is billed upfront when indicated.
8.2 Plan Changes
PFP may permit upgrades and downgrades.
Before confirmation, the Service will display available information concerning the new plan, price, billing period, effective date, Pretty Edit allowance, and any immediate charge, credit, or proration.
An upgrade may take effect immediately with a disclosed prorated charge. A downgrade ordinarily takes effect at the end of the current paid period unless another effective date is displayed and accepted.
8.3 Cancellation
You may cancel a recurring subscription using the cancellation mechanism available through your PFP account or the payment platform responsible for the purchase.
Cancellation prevents renewal for another billing period.
Unless otherwise disclosed or required by law:
- Cancellation does not immediately end the paid period already purchased.
- Paid access continues through the applicable paid-through date.
- Included Pretty Edits remain subject to their normal monthly expiration.
- Purchased Pretty Edits remain associated with the account.
- Cancellation does not automatically create a refund.
- The account may transition to Pretty Free after paid access ends.
Deleting the application, stopping use, or removing a payment method does not automatically cancel a subscription.
Canceling a subscription does not delete your PFP account, Gallery, Favorites, or purchased Pretty Edits. Account deletion is a separate action.
8.4 Refunds
Except where otherwise stated or required by applicable law, completed subscription payments, Pretty Edit Pack purchases, and other charges are generally non-refundable.
Cancellation ordinarily does not produce a prorated refund for:
- Unused subscription time.
- Unused included Pretty Edits.
- A partially used billing period.
- A valid generated result that did not match a subjective preference.
PFP may provide a refund, partial refund, account credit, restored Pretty Edit, corrected charge, or another remedy for circumstances such as:
- A verified duplicate or incorrect charge.
- A charge processed after properly completed cancellation.
- A paid service that was not delivered.
- A technical or accounting error.
- A supported unauthorized transaction.
- A remedy required by law.
Nothing in these Terms limits consumer rights that cannot lawfully be waived.
8.5 Price Changes and Taxes
PFP may change prices for future purchases or future renewal periods. A price change will not retroactively alter a completed charge.
PFP will provide advance notice or obtain additional consent where required by law before a new price applies to an existing customer’s renewal.
Displayed prices may exclude applicable taxes unless stated otherwise. PFP or its payment provider may calculate and collect taxes required by law.
9. Payments and Failed Payments
PFP may use third-party payment processors to manage subscriptions and purchases.
Payment information may be collected and processed directly by the applicable provider under its terms and privacy practices.
PFP may receive limited transaction details such as:
- Payment-processor customer and transaction identifiers.
- Subscription status.
- Amount and currency.
- Billing dates.
- Payment success or failure.
- Refund and dispute records.
- Card brand and limited card details such as the final four digits.
PFP does not intend to store complete payment-card numbers or card security codes in its ordinary application database.
9.1 Failed Payments
If a renewal payment fails, PFP or its payment provider may:
- Notify you.
- Ask you to update your payment method.
- Retry the authorized payment method.
- Temporarily mark the subscription past due.
- Restrict paid functionality.
- Move the account to the available Free plan.
- Cancel the subscription if payment remains unresolved.
PFP may ordinarily provide up to seven days to resolve a legitimate failed renewal payment.
A failed payment will not, by itself, delete the account, properly retained Favorites, or valid Pretty Edits purchased separately.
9.2 Billing Questions and Disputes
If you believe a charge is incorrect, duplicated, or unauthorized, contact support@prettyfreakingphoto.com with the account email, date, amount, applicable plan, and available transaction information.
Do not send passwords, complete card numbers, bank credentials, or card security codes through email.
Nothing in these Terms prevents you from exercising lawful payment-dispute or chargeback rights.
A good-faith dispute will not, by itself, result in retaliation or permanent termination. Fraudulent, deceptive, or abusive misuse of payment disputes may result in account restriction, balance correction, suspension, or termination.
PFP may provide relevant account, acceptance, purchase, subscription, usage, cancellation, and delivery records to authorized payment processors, financial institutions, card networks, or dispute-resolution providers when reasonably necessary to investigate a disputed transaction.
10. Acceptable Use and Prohibited Conduct
You may use PFP only for lawful purposes and in a manner that respects the safety, dignity, privacy, and rights of others.
You may not use the Service to create, upload, generate, transform, store, download, publish, or distribute content that:
- Violates applicable law.
- Infringes copyright, trademark, privacy, publicity, likeness, contractual, or other rights.
- Uses another person’s image or protected material without required permission.
- Contains child sexual abuse material or sexualized depictions of minors.
- Facilitates grooming, trafficking, exploitation, or abuse.
- Contains pornography, non-consensual intimate imagery, sexual deepfakes, or voyeuristic content.
- Facilitates harassment, stalking, bullying, blackmail, threats, or severe abuse.
- Promotes hatred, violent extremism, credible violence, or serious physical harm.
- Facilitates fraud, phishing, scams, identity theft, or deceptive impersonation.
- Creates false evidence, identification, official documents, testimonials, endorsements, or business results.
- Exposes sensitive personal information for a harmful or unlawful purpose.
- Facilitates illegal goods, weapons, drugs, exploitation, or dangerous criminal activity.
- Is intended to evade safety systems or provider restrictions.
PFP must not be used as the sole basis for high-impact decisions concerning employment, housing, credit, insurance, healthcare, education, legal services, government benefits, or access to essential services.
You may not:
- Access another account or system without authorization.
- Introduce malware or harmful code.
- Probe or exploit vulnerabilities without written authorization.
- Scrape, crawl, overload, disrupt, or interfere with the Service.
- Circumvent access controls, rate limits, security systems, payment controls, or Pretty Edit accounting.
- Use unauthorized bots, scripts, or automated account-creation methods.
- Reverse engineer or attempt to extract protected source code, prompts, model instructions, or workflows except where applicable law expressly permits.
- Create multiple accounts to obtain additional free usage or promotions.
- Submit fraudulent refund, restoration, failure, or payment claims.
- Sell, transfer, pool, or manipulate Pretty Edits.
- Evade a restriction, suspension, or termination.
PFP may use automated systems, provider safeguards, and authorized human review to detect and investigate suspected violations.
Depending on the circumstances, PFP may reject a request, remove or restrict content, issue a warning, correct a balance, limit a feature, suspend or terminate an account, preserve relevant records, or report apparent unlawful activity when required or permitted by law.
11. PFP Intellectual Property
Except for User Content, eligible Outputs, and third-party materials, PFP and its licensors own all rights, title, and interest in the Service.
This includes:
- Software, source code, systems, architecture, and APIs.
- Proprietary prompts, workflows, and quality-control methods.
- Features, tools, interfaces, layouts, graphics, icons, and design elements.
- Templates, looks, effects, presets, and creative assets.
- Databases, documentation, and written materials.
- PFP names, logos, trademarks, branding, and trade dress.
Subject to these Terms, PFP grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to use the Service through authorized interfaces.
You may not copy, sell, resell, white-label, mirror, frame, sublicense, reverse engineer, commercially redistribute, or provide unauthorized access to the Service.
You may not separately extract or commercialize PFP templates, looks, presets, prompts, effects, interface elements, workflows, or proprietary assets merely because they appear within an Output.
If you voluntarily provide feedback, ideas, or suggestions about PFP, you authorize PFP to use them without restriction, attribution, or compensation. This does not transfer ownership of your photographs, User Content, or Outputs.
12. Rights and Content Complaints
PFP respects intellectual-property, privacy, publicity, likeness, and other legal rights.
If you believe content or activity associated with PFP violates your rights, contact:

Include, when available:
- Your name and contact information.
- A description of the affected right.
- Identification of the work, image, likeness, mark, or material involved.
- Information reasonably sufficient to locate the content.
- An explanation of why you believe the use is unauthorized.
- Information supporting your ownership or authority.
- The action requested.
- A statement that the information provided is accurate.
PFP may request additional information or verification.
After reviewing a sufficiently complete report, PFP may restrict, remove, preserve, restore, or leave the applicable content available; contact the affected account holder; request more information; suspend an account; refer the matter to a provider or authority; or take another action permitted by law.
Reports involving minors, non-consensual intimate imagery, fraudulent impersonation, credible threats, or immediate safety concerns may receive priority.
You may not knowingly submit false, fraudulent, misleading, or abusive rights complaints.
13. Third-Party Services
PFP uses authorized third-party technologies and providers to operate and support the Service.
Providers may perform functions involving:
- Artificial-intelligence processing.
- Image generation and analysis.
- Authentication.
- Hosting and infrastructure.
- Databases and file storage.
- Payment processing.
- Email delivery.
- Security and fraud prevention.
- Analytics, support, and performance monitoring.
PFP may transmit a main photograph, permitted references, customer instructions, system instructions, technical data, and correction information to an AI provider when reasonably necessary to fulfill a request.
PFP does not intentionally include complete payment-card information in AI-generation requests.
Providers may apply their own safety controls, technical restrictions, rate limits, and legal requirements. A request may be rejected, filtered, delayed, interrupted, or unable to produce a result.
PFP may add, remove, replace, or supplement providers when reasonably necessary to maintain, secure, improve, or operate the Service.
A subscription does not create a permanent right to a particular provider, model, model version, endpoint, payment processor, hosting service, or technical architecture.
Material data-processing practices are explained in our Privacy Policy.
14. Suspension, Termination, and Account Closure
Subscription cancellation, account deletion, temporary suspension, and account termination are separate actions.
14.1 Voluntary Account Deletion
You may request account deletion through an available account feature or authorized support channel.
Before deletion, PFP may require verification and affirmative confirmation.
Account deletion may permanently remove:
- Account access.
- Gallery content and Favorites.
- Recently Deleted items.
- Generated images and history.
- Included and purchased Pretty Edits.
- Settings and preferences.
- Other associated information.
Download any content you wish to preserve before deleting your account. PFP may be unable to restore an account or its content after deletion is completed.
Certain security, payment, tax, fraud-prevention, dispute, backup, or legally required records may remain for an appropriate period as described in our Privacy Policy.
14.2 Restrictions and Suspension
PFP may restrict or suspend some or all functionality when reasonably necessary to:
- Investigate a suspected violation.
- Protect an account, customer, provider, third party, or PFP.
- Address fraud, account compromise, or unauthorized access.
- Prevent abuse of Pretty Edits, promotions, subscriptions, payments, or refunds.
- Investigate a credible safety, rights, or legal complaint.
- Protect service security, availability, or integrity.
- Comply with applicable law or valid legal process.
Where a narrower restriction is reasonably sufficient, PFP may limit only the affected feature.
14.3 Termination
To the extent permitted by law, PFP may terminate an account for a material or repeated violation, fraud, serious payment abuse, unlawful conduct, child exploitation, non-consensual intimate imagery, serious rights infringement, security attacks, unauthorized scraping, harmful impersonation, or another material legal, safety, or operational risk.
PFP may take immediate action without advance notice when reasonably necessary to address fraud, account compromise, child-safety concerns, serious unlawful activity, imminent harm, or security threats.
Where appropriate, PFP may provide notice, an opportunity to respond, or instructions for requesting review.

15. Service Availability and Changes
PFP will make reasonable efforts to operate the Service reliably. However, internet-based, AI, hosting, storage, payment, authentication, and communications systems cannot be guaranteed to function continuously or without error.
The Service may experience delays, interruptions, reduced performance, or temporary unavailability because of maintenance, demand, provider failures, network issues, security incidents, software changes, device incompatibility, legal requirements, or circumstances outside PFP’s reasonable control.
PFP may queue, delay, limit, retry, or cancel incomplete requests during periods of reduced capacity.
An estimated completion time is not a guaranteed delivery deadline unless PFP expressly states otherwise.
PFP should not mark a generation successful or deduct a Pretty Edit unless a valid generated image is returned and made available through the customer’s account.
Customers should independently preserve important content. Temporary Gallery unavailability does not necessarily mean content has been deleted.
PFP may provide an appropriate remedy for a qualifying service failure, which may include restoring a Pretty Edit, retrying a request, correcting a balance, extending a usage period, providing complimentary Edits, issuing an account credit, restoring access, or providing a refund where appropriate or legally required.
16. Disclaimers
The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law.
Except for an express written commitment made by PFP, PFP and its licensors and providers disclaim implied or statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, compatibility, and warranties arising from usage or course of dealing.
PFP does not guarantee that:
- Every Output will satisfy your preferences or objectives.
- Every request will process successfully.
- The Service will always be uninterrupted or error-free.
- Every feature will work on every device or platform.
- Every technical problem will be corrected immediately.
- Every Output will be unique, legally protectable, or appropriate for commercial use.
- PFP will generate revenue, engagement, customers, followers, or another business result.
- Every provider, model, feature, template, or look will remain available.
PFP does not independently verify ownership, permission, consent, legal clearance, or factual accuracy for every item submitted or generated.
PFP provides creative technology and does not provide legal, medical, financial, tax, regulatory, investigative, or other professional advice.
The Service must not be used to create or alter government identification, medical or diagnostic imagery, official legal evidence, financial records, authenticity documents, or other high-stakes records.
Nothing in these Terms excludes warranties, remedies, consumer protections, or other rights that cannot lawfully be excluded.
17. Limitation of Liability
To the fullest extent permitted by law, PFP and its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Service, these Terms, User Content, Outputs, account actions, provider failures, or your use or inability to use the Service.
Excluded losses may include lost profits, lost revenue, lost opportunities, business interruption, loss of goodwill, loss of data, substitute-service costs, and losses resulting from reliance on an AI-generated Output.
To the fullest extent permitted by law, the combined liability of PFP and the protected parties for all claims arising from the Service or these Terms will not exceed the greater of:
- US $100; or
- The total amount you paid directly to PFP during the 12 months preceding the event that first gave rise to the claim.
This limit does not prevent PFP from voluntarily restoring Pretty Edits, correcting balances, retrying generations, providing credits, issuing refunds, or offering another customer remedy.
These limitations do not apply where liability cannot lawfully be excluded or limited, including where applicable law provides otherwise for fraud, willful misconduct, gross negligence, death or personal injury, or certain privacy, security, payment, and consumer-protection claims.
18. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless PFP and its affiliates, officers, directors, employees, contractors, licensors, service providers, successors, and permitted assigns from qualifying third-party claims arising from:
- User Content you submit.
- Your instructions or use of Outputs.
- Your material violation of these Terms or the Acceptable Use Policy.
- Your violation of applicable law.
- Your violation of another person’s intellectual-property, privacy, publicity, likeness, contractual, or other rights.
- Your failure to obtain required permission, consent, license, or release.
- Your fraudulent, deceptive, abusive, or unlawful conduct.
- Your misuse of Pretty Edits, subscriptions, payments, promotions, or account systems.
- Your unauthorized access to or interference with the Service.
This obligation does not apply to the extent a claim was legally caused by PFP’s fraud, willful misconduct, gross negligence, material breach, unlawful conduct, or unauthorized use of User Content.
PFP will provide reasonably prompt notice of a covered claim and may control its defense. PFP will not settle a claim in a way that imposes an admission of wrongdoing or an additional direct nonmonetary obligation upon you without your consent.
Consumer indemnification obligations apply only to the maximum extent permitted by applicable law.
19. Disputes and Individual Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS AN AGREEMENT TO RESOLVE MOST DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION, A CLASS-ACTION WAIVER, AND A JURY-TRIAL WAIVER.
19.1 Informal Resolution
Before beginning arbitration or filing a court action, the party bringing the dispute must send a written Notice of Dispute and allow at least 30 days for informal resolution.

Include your name, account email, a description of the dispute, relevant transaction or account information, and the requested resolution.
19.2 Governing Law
Subject to the Federal Arbitration Act and mandatory rights that cannot be waived, these Terms are governed by Delaware law without regard to conflict-of-laws rules.
This choice does not deprive consumers of mandatory protections provided by the laws of their place of residence.
19.3 Individual Arbitration
Except for matters excluded below, you and PFP agree to resolve disputes arising from the Service, these Terms, subscriptions, Pretty Edits, User Content, Outputs, advertising, privacy, account enforcement, or the customer relationship through binding individual arbitration rather than court.
Arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules or other rules appropriate for the dispute. Information is available at adr.org.
Consumer arbitration may ordinarily occur through written submissions, telephone, video conference, or in the customer’s county of residence.
19.4 Claims Outside Arbitration
The following matters are not required to be arbitrated:
- Eligible individual small-claims matters.
- Reports to government agencies or regulators.
- Claims that applicable law prohibits from mandatory arbitration.
- Requests for urgent relief involving system attacks, unauthorized access, trade secrets, or intellectual-property misuse.
- Matters the parties agree in writing to resolve in court.
19.5 Class-Action and Jury Waivers
To the fullest extent permitted by law, each party may bring claims only in an individual capacity and not as a plaintiff or member of a class, collective, consolidated, mass, private-attorney-general, or representative action.
An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party’s claim.
To the fullest extent permitted by law, you and PFP waive the right to a jury trial for disputes proceeding in court.
19.6 Arbitration Opt-Out
You may opt out of the arbitration agreement by sending written notice within 30 days after first accepting the version of these Terms containing it.
Send the notice to support@prettyfreakingphoto.com with the subject “Arbitration Opt-Out.”
Include your full name, PFP account email, the date, and a clear statement that you are opting out of arbitration.
Opting out will not affect your access, plan eligibility, pricing, or account treatment.
19.7 Court Venue
If a dispute is not subject to arbitration or you validly opt out, the parties consent to appropriate state or federal courts in Delaware, except where mandatory consumer law permits or requires another location.
20. Changes to These Terms
PFP may update these Terms to reflect changes in the Service, features, billing, Pretty Edits, technology, providers, security, operations, or applicable law.
Each version will display a Last Updated date and may include a version identifier.
PFP may provide notice of a material change through email, an in-app notice, login notice, website notice, or a request for renewed acceptance.
When commercially reasonable, PFP intends to provide at least 30 days’ advance notice before a material change applies to an existing customer. A shorter period may be used when necessary to address law, security, fraud, provider requirements, material harm, or urgent operational needs.
Where legally required, PFP will obtain affirmative acceptance, provide an opportunity to cancel, or offer another applicable right.
An update will not automatically:
- Remove valid purchased Pretty Edits.
- Convert a non-expiring purchased balance into an expiring balance.
- Apply a new subscription price without required notice.
- Authorize a retroactive charge.
- Eliminate a consumer right that cannot lawfully be waived.
When affirmative acceptance is not required, continued use on or after the effective date may constitute acceptance after legally sufficient notice.
PFP may preserve historical versions and records showing the version presented, acceptance date, acceptance method, associated account, and applicable subscription transaction.
21. General Provisions
These Terms, the Acceptable Use Policy, and applicable feature or purchase terms constitute the agreement between you and PFP concerning the Service. The Privacy Policy governs PFP’s processing of personal information.
If a provision is unlawful or unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue where legally permitted.
Failure to enforce a provision immediately does not waive the right to enforce it later.
You may not transfer your account or assign these Terms without PFP’s consent where such a restriction is lawful.
PFP may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, transfer to an affiliate, or transfer of the Service. Any successor remains subject to applicable customer rights and valid purchased benefits.
These Terms do not create a partnership, joint venture, employment, franchise, fiduciary, or agency relationship between you and PFP.
PFP may provide agreements, receipts, disclosures, notices, and transaction records electronically where permitted by law.
You must use the Service in compliance with applicable laws, including applicable export-control, trade, and sanctions laws.
Provisions that should continue by their nature survive cancellation, deletion, suspension, termination, and discontinuation. These may include provisions involving ownership, accrued payments, intellectual property, complaints, record preservation, disclaimers, liability, indemnification, and disputes.
The English-language version controls if a translation materially conflicts with it, except where applicable law requires otherwise.
